The PRY name, PRY logo, Painery® trade mark, product names, designs, photographs, campaign imagery, website content, graphics, videos, written content, branding and all other material displayed on this website are owned by, licensed to, or used with permission by PRY and/or the relevant rights holder.

 3. Use of Our Website

You must use this website lawfully and in accordance with these Terms.

You must not:

  • Use the website in a way that disrupts, damages or interferes with its operation.

  • Attempt to gain unauthorised access to our systems, customer accounts, website data or payment systems.

  • Introduce viruses, malware, harmful code or other material that is technologically harmful.

  • Use automated systems, bots, scrapers, data-mining tools or similar methods without our written consent.

  • Provide false, misleading or fraudulent information.

  • Use the website for unlawful, abusive, defamatory, discriminatory or inappropriate purposes.

  • Buy products for unauthorised resale or commercial distribution without our written approval.

We may suspend, restrict or terminate access to the website where we reasonably believe that these Terms have been breached.

4. Products and Product Information

We take reasonable care to ensure that product descriptions, prices, measurements, sizing information and photographs are accurate at the time they are published.

However:

  • Colours may appear differently depending on your device, screen settings and lighting conditions.

  • Measurements and sizing information are provided as guides and may vary slightly between garments or production runs.

  • Minor differences in colour, fabric placement, stitching, finish or appearance will not usually amount to a fault where the item remains of satisfactory quality, fit for purpose and as described.* Product availability is not guaranteed.

  • We may amend, update or discontinue products at any time.

Please check product descriptions, size guides and care instructions carefully before placing an order.

5. Orders and Acceptance

When you place an order, you are making an offer to purchase the selected products from PRY.

After you place an order, we will send an automated order-confirmation email. This confirms that we have received your order, but it does not mean that your order has been accepted.

A contract between you and PRY is formed only when we send you a dispatch-confirmation email confirming that your order has been accepted and sent.

We may refuse, cancel or limit an order before dispatch where we reasonably believe that:

  • A product is unavailable.

  • There is an obvious error in the price, product description, promotion or stock availability.

  • Payment has not been authorised or cannot be collected.

  • The order appears to be fraudulent, unauthorised or intended for unauthorised resale.

  • You have provided incomplete, inaccurate or misleading information.

  • Fulfilling the order would breach applicable law or these Terms.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6. Prices and Payment

All prices are shown in GBP (£) unless otherwise stated.

Prices may change at any time, but changes will not affect orders that have already been accepted by us.

Where applicable, prices include VAT. Delivery charges, taxes, customs charges and any other applicable costs will be shown at checkout before you complete your purchase.

Payment must be made in full at the time of placing your order using one of the payment methods available at checkout.

By placing an order, you confirm that you are authorised to use the chosen payment method. Payments are processed by third-party payment providers. We do not store your full payment-card details.

7. Delivery

Our Shipping Policy forms part of these Terms and Conditions.

We currently ship to the United Kingdom, selected European destinations and the United States, subject to availability at checkout.

Estimated delivery times and delivery costs will be shown at checkout.

Delivery times are estimates only and may be affected by matters outside our reasonable control, including courier delays, customs clearance, severe weather, industrial action, transport disruption and high-volume sales periods.

You are responsible for providing a complete and accurate delivery address. We cannot accept responsibility for delays, failed deliveries or lost parcels caused by incorrect, incomplete or inaccessible delivery details provided by you.

Risk in the products passes to you when the products are delivered to the address, safe place, neighbour, collection point or other delivery location specified in your order.

Ownership of the products passes to you once we have received payment in full.

8. International Orders, Customs and Import Charges

For orders delivered outside the United Kingdom, customs duties, import VAT, sales taxes, handling fees or other charges may be imposed by the destination country.

Unless we expressly state at checkout that duties and taxes are included, these charges are your responsibility.

You are responsible for ensuring that the products you order can lawfully be imported into your delivery country and for complying with all relevant customs, tax and import requirements.

If an order is returned to us because customs charges were not paid, delivery was refused, the parcel was not collected, or the address provided was incorrect, we may deduct the original delivery cost and any return-to-sender costs from any refund due.

9. Your Right to Cancel

If you are purchasing as a consumer in the United Kingdom, you usually have the right to cancel your order within 14 days of receiving your goods, without giving a reason.

To cancel an order, you must notify us clearly within the cancellation period by emailing contact@painery.co.uk

Please include:

  • Order number

  • Name

  • Address

  •

You must return the goods to us within 14 days of telling us that you wish to cancel.

Unless an item is faulty, incorrect or not as described, you are responsible for the cost of returning it to us.

10. Returns and Refunds
Our Refund Policy forms part of these Terms and Conditions.

Returned items should be sent back unworn, unused, unwashed and, where reasonably possible, with original tags and packaging.

You may inspect an item as you would in a shop, but please take reasonable care of it while it is in your possession. We may make a deduction from your refund if an item has been handled beyond what is reasonably necessary to inspect its nature, characteristics and functioning.

For hygiene reasons, we may not accept the return of sealed goods that are not suitable for return once unsealed where this has been clearly stated before purchase and the seal has been removed.

Personalised, bespoke or made-to-order products may not be eligible for cancellation or return unless they are faulty, damaged or not as described.

Where you validly cancel an order, we will refund the price paid for the returned item and, where required by law, the cost of our standard outbound delivery service.

If you selected a delivery service more expensive than our standard delivery option, we will not be required to refund the additional delivery cost.

Refunds will be made using the original payment method unless we agree otherwise.

We may withhold a refund until we have received the returned goods or evidence that you have sent them back, whichever happens first.

11. Faulty, Damaged or Incorrect Items

Nothing in these Terms affects your legal rights if an item is faulty, damaged, not as described or otherwise does not meet the required legal standard.

If you receive a faulty, damaged or incorrect item, please contact us as soon as possible at contact@pryofficial.com

Please include:

  • Your order number.

  • A description of the issue.

  • Clear photographs of the item, fault, damage and packaging where relevant.

We may ask you to return the item for inspection before confirming the appropriate remedy. Depending on the circumstances, this may include a repair, replacement, partial refund or full refund.

12. Pre-Orders

Where an item is sold as a pre-order, the estimated dispatch date will be stated on the relevant product page and/or at checkout. Pre-order dates are estimates and may change due to production, quality-control, shipping or customs delays.

Where an order includes both pre-order and in-stock items, we may send the full order together once all items are available, unless otherwise stated at checkout.

13. Promotional Codes and Offers

Promotional codes, discounts, competitions and other offers are subject to any specific terms displayed with the promotion.

Unless otherwise stated:

  • Promotional codes cannot be used in conjunction with other offers.

  • Promotional codes cannot be exchanged for cash, credit or gift cards.

  • Promotional codes may only be used once per customer or transaction.

  • Promotional codes may exclude delivery charges, sale items, limited releases, gift cards or selected products.

  • We may withdraw, amend or suspend a promotion where reasonably necessary.

We reserve the right to cancel orders where a promotional code has been used incorrectly, fraudulently or in breach of its terms.

14. Reviews, Social Media and User Content

Where you submit a review, photograph, video, comment, tag, mention or other content relating to PRY or Painery® (“User Content”), you confirm that:

  • You own the User Content or have permission to share it.

  • The User Content is accurate, lawful and does not infringe another person’s rights.

  • The User Content is not abusive, threatening, discriminatory, defamatory, misleading, obscene or otherwise inappropriate.

By submitting User Content or tagging PRY on social media, you grant us a non-exclusive, royalty-free, worldwide licence to repost, share, adapt, publish and use that content for our website, social-media, marketing and promotional purposes.

We will make reasonable efforts to credit you where appropriate.

You may ask us to stop using User Content that identifies you by contacting us at contact@pryofficial.com.

This will not affect content already printed, published, produced or included in campaigns that are already underway.

15. Privacy

We process personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information when you visit our website, create an account, contact us or place an order.

16. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by our negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of your statutory consumer rights.

  • Any liability that cannot lawfully be excluded or limited.

Subject to the above, we are not liable for losses that are not reasonably foreseeable, losses caused by events outside our reasonable control, or business losses where you purchase products as a consumer.

We are not responsible for any loss arising from misuse of a product, failure to follow garment-care instructions, unauthorised alteration, normal wear and tear, accidental damage or improper storage.

17. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our business, website, products, services, legal requirements or operational processes.

The version published on the website at the time you place your order will apply to that order.

18. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be treated as removed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

19. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer living outside England and Wales, you may also benefit from mandatory consumer-protection laws in your country of residence where those laws apply.

Any dispute arising in connection with these Terms or an order will be subject to the courts of England and Wales, except where applicable consumer law gives you the right to bring proceedings in your country of residence.

The content found on this page is intended to offer a high-level overview of the terms and conditions relevant to our branding portfolio services. It is not to be construed as legal advice. We recommend consulting with a legal professional to tailor these terms to fit the unique aspects of your brand and its relationship with clients.

Understanding Branding Portfolio T&C

These Terms and Conditions (T&C) outline the legal framework governing the relationship between PRY and its clients. They clarify the expectations for both parties when engaging with our branding portfolio services, ensuring a mutual understanding of rights and responsibilities within this creative partnership. Each branding project is distinct, and thus the T&C must be crafted to reflect the specifics of our offerings and client needs.

Key Elements of Our Branding T&C

Typically, our T&C will cover aspects such as eligibility to engage with our services, payment procedures, and the potential for future changes to service offerings. Additionally, they address intellectual property rights, client confidentiality, and our authority to modify project terms as necessary. These elements help ensure clarity and protection for both PRY and our clients, fostering a professional and trustworthy environment.
